Moment Savvy

Terms of Use

Draft for legal review — not approved for publication. Effective date and last updated: to be set on publication.

Confirm the operator, registered business/contact details, and monitored support mailbox. Obtain jurisdiction-specific review of the proposed liability cap, consumer protections, safety wording, Apple licence relationship, and Canadian/Québec language requirements. The monetary cap below is a drafting position, not an assurance of enforceability.

These Terms govern the Moment Savvy mobile application, website, wellness content, and related services (the “Service”). The proposed operator is Moment Savvy AB, Sweden (“Moment Savvy”, “we”, “us”, or “our”). Contact: .

Publication details to complete: verified registered company name, registration number, business address, and other legally required contact information.

Sections 3–4 explain wellness scope and safety limitations. Sections 12–14 address disclaimers, liability, and misuse. Nothing here removes a right or remedy that applicable law does not allow us to exclude.

Important health and safety notice: no app content is health or medical advice. It must never replace medical advice of any kind, professional assessment, diagnosis, or treatment. Choosing to try a practice is voluntary and undertaken at your own risk, subject to the mandatory rights and responsibilities preserved in sections 12–13.

1. Agreement and eligibility

You must be at least 16 years old to create an account or use Moment Savvy. If permission from a parent or legal guardian is required under the laws where you live, you must obtain that permission before using the Service. App Store content ratings do not verify age or replace these eligibility requirements.

Before Apple or Google sign-in, the app asks you to confirm that you are at least 16, agree to these Terms, and acknowledge the Privacy Policy. If you do not agree, do not create or continue using an account. Privacy acknowledgement is not blanket consent to processing.

These Terms apply where validly presented and accepted under applicable law. Merely opening a public web page does not, by itself, constitute acceptance of every contractual restriction here.

2. The Service, Free, and PLUS

Moment Savvy offers general wellness information and guided practices, organized into areas, with favorites, editorial updates, and previews. Availability and suitability can vary.

All content is for general information and personal wellness purposes only. This includes practice instructions, summaries, images, editorial articles, previews, and linked recommendations. None is health or medical advice or a recommendation tailored to your health. Never use it as a substitute for medical advice of any kind or other qualified professional care.

The current version includes Free content and may show locked PLUS-labelled content. PLUS cannot be purchased in this version. A label or waitlist invitation is not a subscription offer or a promise of future access. A paid service would require separate pricing, billing, cancellation, and other required disclosures before purchase.

You need a supported device/operating system, Apple or Google account, and internet access for cold launches, authentication, access verification, content refresh, and account operations. Some cached content may be available during a session, but full offline operation is not promised. Network-provider charges may apply.

3. General wellness and safety

Moment Savvy and its app content do not provide health or medical advice, diagnosis, treatment, psychotherapy, crisis intervention, or emergency services. Content is general information, not a personalized assessment or prescription. No doctor-patient, therapist-client, fiduciary, or other professional-care relationship is created.

The Service cannot assess your health, injuries, medications, pregnancy, disability, mental-health needs, or individual circumstances. A practice may be unsuitable even if useful to someone else. Consult an appropriately qualified professional before trying a practice if you have a condition, symptoms, or another reason for caution.

You choose whether to try, continue, adapt, or stop a practice. Participation is voluntary and at your own risk. Physical or mental wellness activities can cause discomfort, injury, distress, or worsening symptoms, and we cannot identify every risk for you. You are responsible for considering your circumstances, following professional advice, and staying within your abilities. This acknowledgement concerns the risks of voluntary participation; it does not waive liability or rights that cannot legally be excluded.

The app must never replace medical advice of any kind. Do not use any content to self-diagnose, change medication, alter a treatment plan, or postpone seeking care. If content conflicts with advice from a qualified healthcare professional, follow that professional's advice and do not perform the conflicting practice.

  • Never delay, replace, or disregard medical advice of any kind, other professional advice, or treatment because of the Service.
  • Choose a safe environment. Do not use a practice while driving, operating machinery, or doing something requiring full attention.
  • Do not push through pain, dizziness, breathlessness, significant discomfort, distress, or worsening symptoms. Stop and seek appropriate advice or urgent help as needed.
  • Adapt or avoid activities beyond your abilities or contrary to your clinician's advice. Instructions cannot identify every individual risk or contraindication.

We do not guarantee a health, emotional, sleep, fitness, productivity, or therapeutic result. Testimonials, descriptions, estimated durations, and editorial content are not promises of outcomes. These limitations do not excuse failure to exercise legally required care or make unsafe content safe merely by including a warning.

4. Emergencies

The Service and support mailbox are not monitored for emergencies and cannot provide crisis intervention. If someone may be in immediate danger, contact local emergency services or seek urgent professional assistance. Do not wait for a support reply.

5. Accounts and security

Use accurate account information and maintain control of your device and Apple/Google account. Do not share access in ways that compromise security, impersonate others, or create an account without authority. Notify support about suspected unauthorized access.

You are responsible for your use and reasonable security precautions. You are not automatically responsible for every unauthorized action regardless of fault, and this does not shift our security duties to you. We may require reauthentication for sensitive operations such as deletion.

6. Privacy

The Privacy Policy explains accounts, favorites, waitlist data, analytics/diagnostics, retention, and rights. Information objectively necessary for an account feature is required for that feature. Optional processing needs any separate permission or legal basis required by law.

Native iOS Analytics and Crashlytics are currently enabled and use the Firebase account identifier through designated User-ID fields after sign-in. There is no current in-app analytics/diagnostics switch. Deletion does not automatically erase historical reports. Accepting these Terms does not waive privacy rights or establish consent for all collection.

Do not put medical records, passwords, authentication codes, financial information, or other sensitive details in display-name or ordinary support fields.

7. PLUS waitlist

Joining is optional, free, and not a purchase. It does not guarantee access, availability, priority, pricing, or a launch date. We may change or close the waitlist for legitimate product, legal, or operational reasons.

The app has no separate leave-waitlist button. Successful deletion removes your record; you may also contact support to request removal. No waitlist or general marketing email is currently sent. Messages must not begin until required permissions, sender information, and an unsubscribe method are available. Email opt-out must be possible without deleting the account or waitlist membership.

8. Licence and intellectual property

Moment Savvy AB owns or licenses the Service and its text, practices, software, designs, graphics, branding, images, and arrangement. Subject to these Terms and any applicable Apple licence, you receive a limited, personal, non-exclusive, non-transferable licence to use available content for your own non-commercial wellness purposes. Access does not transfer ownership or authorize redistribution.

Except where permitted by mandatory law or our written permission, do not:

  • Copy, reproduce, republish, sell, sublicense, or commercially exploit the Service/content.
  • Scrape, systematically download, build a database, train a commercial model, or build a competing service from it.
  • Reverse engineer software, access non-public source code, or remove copyright, trademark, or attribution notices.
  • Present content as professional medical/therapeutic advice or imply our endorsement.

Uses or exceptions that cannot lawfully be restricted remain available. The licence may end only consistently with termination provisions and applicable law.

9. Acceptable use

Do not use the Service unlawfully or fraudulently, attempt unauthorized access, interfere with security/availability, distribute malicious code, automate abusive requests, impersonate others, infringe rights, bypass access restrictions, or cause harm. Do not access or retain another user's information while reporting a security concern.

10. Third-party services and Apple

The Service relies on Apple, Google, Firebase, network providers, and your device, and may link to independent sites. Separate terms/privacy notices can apply. We do not control independent third-party content or operation and do not endorse every linked resource. We remain responsible for duties imposed on us when using third parties.

For an App Store app, Apple's Standard Licensed Application End User License Agreement applies unless a valid custom licence is supplied through Apple. These Service Terms supplement rather than override applicable Apple usage rules and mandatory rights. Review the final App Store licence configuration before publication. Direct Moment Savvy support enquiries to us.

11. Availability, updates, and feature changes

We aim for reliability but cannot promise continuous/error-free availability, compatibility with every device, or permanent availability of each feature. Maintenance, security incidents, network/provider failures, and required updates may interrupt access. The app may require an update for supported operation.

We may reasonably change or discontinue content/features for safety, security, law, provider changes, technical limits, or product development. Material changes must respect promises, notice requirements, and consumer remedies. This is not an unrestricted right to remove benefits or impose charges.

To the extent law permits, we are not responsible for delays caused solely by events outside our reasonable control, provided we take reasonable steps to limit their effects. This does not excuse avoidable failures, legal obligations, or remedies that remain due.

12. Disclaimers and mandatory rights

App content is not health or medical advice and must never replace medical advice of any kind. Trying a practice is a voluntary decision made at your own risk, within your abilities and with appropriate professional guidance. No description of potential benefits guarantees safety, suitability, or results for you.

Where law requires it, we provide the Service with reasonable care and skill and meet mandatory standards for digital content/services. Consumer guarantees, statutory remedies, and rights arising from our representations continue to apply.

Subject to those rights, we do not promise that general content fits every situation, achieves a result, or is always complete, current, or available. Use reasonable judgment about suitability and follow professional advice. Where legally permitted, we exclude implied warranties that are not mandatory, including fitness for a particular purpose. This does not exclude express promises or legally required standards.

Australian consumers retain applicable Australian Consumer Law guarantees and remedies. UK, Canadian, US, and other consumers retain their mandatory protections. A free Service does not by itself remove legal rights.

13. Limitations of liability

The own-risk warnings in these Terms apply to your voluntary decision to undertake wellness practices. The content must never replace medical advice of any kind. Those warnings do not excuse our breach, negligence, or failure to exercise legally required care, and do not exclude the liabilities or mandatory rights preserved below.

Liability we do not exclude

Nothing here excludes or limits liability for fraud/fraudulent misrepresentation, willful misconduct, gross negligence where limitation is prohibited, death or personal injury caused by negligence where exclusion/limitation is prohibited, mandatory consumer guarantees/remedies, or other liability law does not permit us to exclude or limit.

Consumer losses

For consumers, we remain responsible for losses that are reasonably foreseeable results of our breach or failure to use legally required care. A loss is foreseeable if it was obvious it would happen or both parties knew it might happen when agreeing. Subject to mandatory law, we are not responsible for unforeseeable losses or business losses arising from a Service supplied for personal, non-commercial use.

Proposed monetary limit for claims lawfully capable of limitation

For a claim that applicable law permits to be subject to a fair and enforceable cap, our aggregate liability for all such claims arising from events in the same 12-month period is limited to the greater of USD 100 (or local-currency equivalent) and the amount you paid directly to us for the Service during the 12 months before the first event giving rise to those claims.

The cap does not apply to the non-excludable categories above, mandatory compensation/remedies, or consumer losses where a cap is unlawful or unfair. V1 is free, but the proposed floor is USD 100 rather than zero. If the cap is not permitted for your claim, that claim remains governed by applicable law.

Draft review note: counsel must review this proposed amount, aggregation period, and exclusions in each launch market before publication. A savings clause does not cure an unfair term.

14. Responsibility for misuse

To the extent permitted by law, you are responsible for direct losses reasonably caused by intentional unlawful use, material breach, or infringement of others' rights. This is not an unlimited indemnity for every claim associated with an account. It does not require compensation for our own breach, negligence, unlawful conduct, or losses we could reasonably have avoided.

15. Suspension, termination, and deletion

You may stop using the Service or delete your account at any time. Use Settings → Delete account and reauthenticate. Contact support if sign-in or deletion fails. Uninstalling alone does not delete an account.

We may suspend or terminate access where reasonably necessary for serious/repeated breach, fraud, abuse, security risk, legal requirements, or lawful discontinuation. Where reasonable and lawful, we will give notice, explain why, and allow an opportunity to address the issue. Immediate action may be needed for urgent legal/security reasons. Contact support if you believe action was mistaken.

Deletion removes account data as described in the Privacy Policy, including waitlist information. Historical provider data and legally necessary records may remain subject to rights and retention. Provisions that by nature need to continue, such as intellectual property, accrued liabilities, and disputes, survive only to the necessary extent. Mandatory remedies remain available.

16. Updates to these Terms

We may update these Terms for legitimate reasons such as changes to law, security, provider dependencies, or the Service. We will state the effective date and give reasonable notice of material changes where required. Material changes apply prospectively and require renewed agreement when required by law.

A general update clause does not authorize unexpected charges, removal of mandatory rights, or materially different terms for past conduct. If you do not accept a material update, you may stop using the Service and delete your account, subject to further legal rights/remedies.

17. Governing law and disputes

Swedish law governs, subject to mandatory protections in your home jurisdiction. Swedish courts have non-exclusive jurisdiction. You may use local courts or other complaint/dispute channels where law gives you that right.

Contact support so we can try to resolve a concern. This is not a mandatory barrier to legal action, waiver of limitation periods, or requirement to surrender a statutory remedy. These Terms do not require mandatory arbitration or waive class-action rights.

18. General terms and contact

An unenforceable provision will be severed or treated as law requires; the remainder continues where legally possible. Delayed enforcement does not waive a right.

You may not transfer contractual rights/obligations except with our consent or as law permits. We may transfer them in a genuine reorganization or Service transfer only if mandatory rights are preserved and required notice is given.

These Terms and validly agreed feature-specific terms govern the Service. The Privacy Policy explains handling; it does not make every processing activity contractually necessary. Nothing here displaces legally binding representations, statutory duties, or remedies.

These Terms may be updated at any time for the legitimate reasons described in section 16. Please review this page periodically. Updates will show a revised effective date and follow the notice and renewed-agreement requirements in section 16. Changes do not apply retroactively or remove rights that applicable law protects.
